摘要
公诉制度是为实现法律的公正和效率价值,对法律实施进行监督的法律制度。公诉价值必须明确,公诉制度的完善才有价值。公诉的基本法理学价值取向在于公诉的公正价值和效率价值。从“程序公正”层面,阐述了公诉的“应然价值”与“实然价值”。
Prosecution system is a kind of legal system to supervise the enforcement of laws in order to realize the justice and efficiency value of laws. Prosecution value must be clear, and it＇s worthwhile to improve prosecution system. So the basic theory of prosecution lies in the justice and efficiency value. From the angle of fair procedures, this article discusses the deserved value as well as actual value of prosecution.
