Research on the Enterprises' Patent Management in China

我国企业的专利管理存在4个缺失:企业专利专门管理机构和专职管理人员缺失;有利于企业专利取得、保护和运营的规章制度缺失;企业专利管理意识缺失;企业专利管理激励机制缺失。针对我国企业专利管理方面存在的问题,借鉴国外先进经验,结合我国国情,提出如下建议:建立科学的企业专利管理机构;培养专职专利管理人才;建立企业专利查新、确权、运营等方面的规章制度;建立促进企业专利成果推广和应用的机制;增强企业专利管理意识;建立企业发明创造奖励机制;对侵犯专利权的行为进行监督、分析、警告、解决。

There＇re 4 disfigurements in the enterprise patent management in China：specific organs and personnel, systems, consciousness of patent management and stimulating mechanism. By learning from the experience of foreign enterprises we must establish the relevant systems ,enhance the patent management consciousness, and take measnres to cope with the patent infringement as well.
