摘要
权益保障是刑法视野下人权保障的重要内容之一,1997年刑法典对财产刑执行过程中的权益保障作了部分规定,但内容尚不完善。对于司法实践中所涉及的一些关于相关人员权益保障问题,有必要作较为深入的探讨,在此基础上,提出了完善财产刑执行过程中权益保障的立法建议。
From the view of criminal law, the guarantee of interests is one of the important contents of guarantee of human interests. Though some contents of the guarantee of interests in the course of property-oriented penalties execution are stipulated by Criminal Code 1997, the stipulation is not so perfect, The article probes deeply into some questions of interests guarantee related with the relevant persons in judicial practice and proposes some legislative suggestions for the perfect of interests guarantee in the execution of property-oriented penalties.
