防震减灾,应尽快完善执法之“术”

Improving the Law-executing Method in Earthquake Prevention and Disaster Mitigation

本文从我国古代春秋战国时期韩非子的理论引出区别于法学理论的概念执法之“术”,并通过对案例的分析和行政法学基本原理的运用,对防震减灾领域缺乏执法之“术”的现状、危害、原因、对策进行了剖析。

This paper introduces the law-executing method from the theory proposed by the ancient Chinese famous scholar named Han Feizi, which is different from the law. Through the analysis of case history and application of the basic principle of administrative law, the paper describes the current situation and hazard caused by the lack of the law-executing method in the field of earthquake prevention and disaster mitigation. The cause and its countermeasures are also analyzed.
