论都市边缘群体——农民工社会保障主体地位的确立及权利制度构建

On the Social Welfare System and Rights of the Marginal Population in China's Cities

都市边缘群体——农民工问题是当前社会较为关注的热点问题。从表象看,农民工劳动权益的维护仅仅涉及农民工用工权、合同权的实现,然而细究这一现象的背后,农民工权益保障的社会保障之一法律制度的匮乏与滞后,无疑是导致系列社会问题与矛盾突出的重要原因与实质。为此,笔者从都市边缘群体——农民工无法享有社会保障的立法现状入手,深入剖析其成因后指出,正是由于农民工社会保障主体地位的缺失,才导致社会保障制度立法对他们群体社会保障权利的漠视与忽略,从而使得农民工社会保障权利如同他们所处的都市边缘化地位一样被边缘化,因而有必要对农民工在现行社会保障制度的地位予以重新审视,确立农民工应有的社会保障主体地位,并以此为基础分层设立符合我国特色的农民工的社会保障制度,从而使其平等分享社会经济与发展成果,这才是构建城乡经济、社会和谐发展的必然之路。

Based on the fact that the urban farmers have no access to social welfare of any kind and enjoy no rights that the people in the city do, the paper analyses the cause of this abnormal phenomenon and the marginalization they are suffering. The cause of the marginalization is the absence of the subject status among this segment of the population, and in order to achieve a balanced development of social economy and a harmonious society substantial measures ought to be taken to eliminate the inequality imposed on the urban farmers.
