我国治安管理处罚制度的建立与发展

Establishment and Development of System on Punishments in Public Order and Security Administration in Our Country

《中华人民共和国治安管理处罚法》(以下简称《治安管理处罚法》)是新中国成立以来第三部实施治安管理处罚的法律,而治安管理处罚制度早在新中国成立后伴随着第一部《中华人民共和国治安管理处罚条例》的实行就已经建立,至此《治安管理处罚法》发布,治安管理处罚制度已较完善。在我国,历史上就创制了独立的违警罚制度,分析研究其起源和演变,为我们把握新中国的治安管理处罚制度的实质提供了历史和理论基础。

＂Law of the People＇s Republic of China on Punishments in Public Order and security Administration＂ （abbreviated as ＂Law of Punishments in Public Security Administration＂ below） is the third law to implement punishments in public order security administration after the establishment of New China, whereas the system of it was set up early with the first one- ＂Regulations of the People＇s Republic of China on Punishments in Public Order and Security Administration＂-soon after the establishment of New China. So, the system on punishments has turned to be rather perfect with the announcement of ＂Law of Punishments in Public Order and Security Administration＂. Historically in our country, independent system on punishments in behaviors against policing regulations was set up there, therefore, to analyze and study its origin and evolution will provide historical and theoretical bases for the nature of system on punishments of New China.
