摘要
相邻关系是物权法中的一个非常复杂的制度,须从不同的视角才能把握其复合性质,并运用多种方法进行调整。相邻关系制度通过划分权利边界、细分权利、限制私权,起到了以下作用:实现不动产的最大价值,做到物尽其用,实现权利人的最大私益,并定分止争,增进社会经济利益。
As adjacent relation is a complex system in real Laws, we should interpret its complex character from different perspectives, and use various regulating methods. Through right limitation, right systematization and private right restriction, we can fulfill the highest value of immovable real and make the best use of it, fulfill the highest private interest of owner and increase the interest of the social economy.
