现行土地征收制度在工业化和城市化的发展中虽起到了一定的积极作用,但其弊端日益凸显,引发了大量的社会问题。特别是国家对集体土地的征收与国有土地使用权出让关系的制度混合,使得国家在土地征收中权力与权利之“公益目的、给予补偿”的宪法制衡被打破,并引致了民众对土地征收法律性质的认识偏差和司法救济的不力,以致于剥夺、侵犯集体经济组织和农民权益的征地行为屡禁不止。因此,探索并研究土地征收中国家权力与权利的制度设计和法源基础具有重大的理论意义和实践价值。

But the disadvantage is more and more obvious and it presents so many social problems.
