论监狱的几个基本问题——犯人、警察与人本

毫无疑问,人文关怀应当是监狱的出发点和归宿,文章从监狱如何对待罪犯观念的探讨入手,鲜明地提出了“对待罪犯的理念决定着不同的监狱类型”的观点;对监狱警察的定位,则既着眼罪犯权利保障,又充分考虑对警察的切实关怀;监狱的标准化的论述同样以对犯罪人的关怀为根基。监狱、警察、犯人及监狱的标准化,诸基本要素无不充满人文关怀的观念,也许这正是监狱存在和发展的“哲学”基础。

Humanistic care is no doubt the starting point as well as the ultimate goal of the prison system. Starting with the discussion of the concept of the treatment of prisoners, the paper puts forward the idea of ＂the type of prison is determined by the concept of the treatment of criminals＂. As for the orientation of the prison guards, we should take into consideration both the safeguarding of the rights of the criminals and the genuine care for the prison guards. The discussion on the standardization of prison is also based on the humanistic care for the prisoners. The humanistic care, thus, may serve as the ＂philosophical＂ basis for the very existence of the prison system and its development.
