完善我国风景名胜区管理体制的法律对策

The Legal Countermeasure of Our Country's Scenic Area's Management

可持续发展是联合国环境与发展大会确立的未来共同发展战略,《中国21世纪议程——中国21世纪人口、环境与发展白皮书》提出了我国的可持续发展战略、对策及行动方案。目前我国风景名胜区的管理主要依据国务院1985年颁布的《风景名胜区管理暂行条例》及实施办法,暂行20年,其中的一些内容已明显不适应当前风景名胜区的可持续发展。因此,制定一部《风景名胜区法》,已成为我国风景名胜区实施可持续发展战略的当务之急。

Sustainable development is the future common develepment strategy which the United Nations Conference on Environment and Develepment establishes, The 21st Century Agenda of China-The White Paper of the 21st Century Population,Environment and Develepment of China has proposed our country＇s sustainable development strategy, plan and the countermeasure of action.At present,our scenic areas＇management depends primarily the Temporary Rules of the management of the Scenic Areas and enforcement measures issued by the State Council in 1985.In its provisional 20 years,some articles among them have been lagged behind to the sustainable development of scenic areas＇presentation. So, constitute the Scenic Areas Law has become the urgent affairs of implementing sustainable development strategy of our country＇s scenic areas.
