关于自贡盐业借贷契约的法律思考

Thinking of the Law of Debit and Credit Contracts in Zigong Salt Industry

盐业借贷契约作为围绕盐业生产经营等经济活动而进行借贷的早期法律文书,与现行《合同法》借款合同之间既有着千丝万缕的联系,又有着许多明显的区别。目前,国内学术界从法律角度对二者进行分析比较的文章较为鲜见。本文以《合同法》借款合同为参照,对我国近现代盐业契约中借贷契约的基本内容和担保制度进行一些粗浅的法律比较。

Debit and credit contracts of salt industry were the early law files. It has countless ties with modern ＂Contract Law＂, but it also has obvious different. At present, analyzing and comparative papers are rare. Consulting the ＂Contract Law＂, this paper is a description of its basic contents debit and credit, ant it also compares that with modern assuring system on the base of law.
