摘要
财产权利与宪政建设紧密结合在一起。财产权利是人权和法律活动的核心,它的确立催生了法治,为建立在市场经济基础上的现代法治的政治形态-宪政奠定了基础。同时,财产权利尤其是私人财产权的保障又依赖民主、法治和宪政的构建。文章从考察财产和财产权利制度的历史演变出发,对宪政建设中财产权利的问题以及两者之间的矛盾进行探讨,为我国建设社会主义政治文明提供有益的借鉴。
Property fights and constitution construction are closely related together. Property rights is the core of human rights and legal activity. Its establishment gave birth to rules by law and radicated deep- set foundation for modem political configuration based on market economy. At the same time, property rights, especially private property rights＇safeguard not only rely on democracy and rules by law ,but also constitution construction. Seeing about it from the historical evolvement of property and property rights, the text discussed the problem of property rights in constitution construction and subsistent contradiction between property rights and constitution construction. It provided beneficial suggestions for our country to construct socialistic political civilization.
