本文主要从国际社会对战争罪犯的历次国际审判,根据1945年《欧洲国际军事法庭宪章》和1946年《东京国际军事法庭宪章,》1991年《前南国际法庭规约》以及2002年生效的《国际刑事法院罗马规约》关于战争罪的规定,对比分析了战争罪内涵的发展变化。

Through comparison, the present paper analyses and discusses the development and change of the contents of war crimes based on the international trials of war criminals, on The Charter of the International Military Tribunal in Europe in 1945 ; The Charter of the International Military Tribunal in Tokyo in 1946 ; the statute of The International Criminal Tribunal in the Former Yugoslavia in 1991, and the statute of The International Criminal Court in Rome in 2002.
