试论反垄断法对滥用知识产权行为的规制

On Antimonopoly Law regulating the Abuse of Intellectual Property Right

通过划定知识产权滥用的边界,分析知识产权法与反垄断法的内在关系;指出反垄断法应该规制的滥用知识产权行为主要有滥用市场支配地位和在许可协议中限制竞争;认为我国建立与知识产权滥用有关的反垄断法具有现实的意义。

By the aid of delimiting the boundary of abuse of intellectual property right, the article analyzes the intrinsic relations between intellectual property law and antimonopoly law, indicates that there are two kinds of action which antimonopoly law should regulate which are abusing dominant position in Market and restricted competition in licensing agreement. The author claims that building up antimonopoly law related to abuse of intellectual property right offers real benefits.
