行政许可实施中的若干现实问题

On several pratical problems in the enforcement of administrative ratification

《行政许可法》的颁布和实施必将有助于深化行政管理体制改革。但是,从《行政许可法》目前的实施情况来看,有些问题还需要进一步明确,增强操作性,以便为完善行政管理体制提供制度保障。本文从实践出发,对实施行政许可中急待研究和明确的问题,尤其是法律法规中未规定或者相冲突的问题在学理上进行了分析说明,希望引起有关方面或者专家的注意,以期完善我国的行政许可法律制度。

It is undoubted that the promulgation and implementation of the Administrative Ratification Law of the Piople＇s Republec of China will enhance the reformation of Chinese administrative system.However,from the perspective of practice,there are still some aspects to be clarified in the Administrative Ratification Law to make it operable and to achieve at a perfect administrative system.This article emphasizes on theoretic analyes on some key issues which are inexplicit or conflicting with other laws or regulations ,aiming at concerns from competent authorities and experts so as to improve Chinese administrative ratification system.
