摘要
以社会性别视角审视劳动和社会保险领域,发现存在诸多性别盲点,构成对女性的性别歧视。在立法中,存在以男性为标准,以女性为客体的误区,导致怀孕女工的特殊权利被忽视,形成女性参与市场竞争的额外障碍。在执法中,有人片面强调企业的用工自主权,剥夺了部分女工的劳动权利。
When reviewing China's labor and social security from the view of gender, the author found some blind spots which actually reflect the discrimination against women. There is an impropriety in legislation, which considered more about men than women and resulted in neglect of the special rights of pregnant women workers. As a resuh, an extra obstacle for women appears in labor market. In implementing realm, unilaterally emphasizing corporation's employment freedom deprives some women workers' labor rights.
