论《治安管理处罚法》警察权扩张的必要性与合理性

On Necessity and Resonableness of Expanding Rights of the Police in "Public Security Administrative Penalty Law"

新近通过的《治安管理处罚法》对警察权的扩张引起不少学者的担忧,认为:警察权力过大会侵害公民权利。因此,需要从警察权扩张的必要性和合理性两方面进行分析论证。一是为顺应社会发展变迁给社会治安工作带来的新情况,国家有必要扩大警察权力;二是为了对扩张后的公民个人权利的有力保障;国家有必在扩大警察权力。

Some sholars are worried about the expansion of the police＇s rights stipulated in the new law ＂Public Security Administrative Penalty Law＂, They believe that expansion of the police＇s rights tend to invade rights of the citizen. Therefore, the article will analyze and discuss the issue in terms of necessity and resonableness of the rights＇expansion. First, it is necessary to expand the rights of the police to confront with some public security problems brought by development of society; second, the kind of expansion will ensure the individual rights of the citizen.
