环保执法中非诉执行案件的有关问题探讨

Discussion on Problems of Non-contentious Administrative Execution Cases in Environmental Protection Enforcement

在目前的环境执法中,由环保部门申请人民法院强制执行的行政处罚已经成为环保部门查处和打击环境违法行为的重要措施．为此对环保部门申请强制执行的期限、非诉执行前的准备工作以及行政复议或者行政诉讼期间,环保行政机关申请强制执行的可行性作了探讨。

In the present environmental protection enforcement, compulsive administrative penalty applied by environmental protection agency to the court has already been an important way in environmental misfeasance punishment. In this paper, the time limit of environmental enforcement, preparation work before non-contentious administrative execution and the feasibility of enforcement during administrative reconsideration or administrative litigation are discussed.
