在我国究竟采取民商合一还是民商分立体例的争论中,商主体的独立价值无疑是一个无法回避的关键问题。同时这也直接影响到我国商主体制度的构建和完善。商主体的独立价值在于其能够独立于民事主体而存在,并通过立法加以确认,从而使得商主体制度发挥其不同于民事主体制度的特殊作用。因此,在我国现有的具体商主体的基础上,构建我国一般商主体制度,对所有商主体作统一的法律规制是必要的。

Thus allowing the commercial subject to display the special role that is disparity to the system of civil subject. Therefore, the construction of the general system for commercial subject on the basis of the existing concrete commercial subject system is crucial to the unified codes for all commercial subjects.
