完善反商业贿赂犯罪立法之思考

Pondering over the Improvement of the Legislation of Anti-Commercial-Bribery

基于全球化的时代背景和我国的现实问题,刑法需要完善商业贿赂犯罪的规定。从刑法立法体例出发,要改变将贿赂犯罪统一规范到一个章节中的做法;从贿赂犯罪的构成要素看,要扩大贿赂的内容、对象和行为方式,取消“为他人谋取利益”、“为谋取不正当利益”之规定。

In view of the background of globalization and the reality of China, the stipulations conceming the crimes of commercial bribery in the Criminal Code should be improved. Seen from the legislation style of the Criminal Code, crime of bribery should not be grouped into one chapter while seen from the constitutive requirements of commercial bribery, the contents, object and conduct of bribery should be expanded and some former enactions should be cancelled.
