保赔保险仅承保承运人的法定责任。无论是以违约来索赔或是以侵权来索赔,索赔人首先要识别起诉所涉及的运输合同。当船东签发自己的提单时,合同认定没有太多困难。但当运输过程涉及两个或两个以上运输单证,且它们又都像是涉及诉讼的运输合同的证明时,情况就会变得复杂。进入国际多式联运与物流时代的今天,集装箱拼箱业务以及无船承运人的存在,使得与无船承运人签订合同的海运承运人的保赔保险在某些情况下会受到影响。
Protection and indemnity insurance only insure carriers' legal responsibility. Whatever claims in the breach of contract or in pirate, the claimer should first identify the transport contract involved. It has no more difficulty to identify the contract when the ship - owner signed his B/L. But it will become complex when transportation involving two or more transport documents, which all seems the certification of the transport contract involved in suit. In the logistics times, the protection and indemnity insurance of carrier signing Contract with NVOCC will be affected in certain circumstances because of the existence of NVOCC and LCL (Less than container load).
