推行“经评审最低投标价中标法”有关问题的探讨

Discussion on the Evaluated-Lowest-Cost-As-Bid-Winner Approach in its Implementation

本文根据国际通行的作法以及我国招投标的法律规定,对招投标法中提出的经评审最低投标价中标法的内涵、作用及推行中存在的误区与正确认识进行了探讨,提出经评审最低投标价中标法应该是通过正当的投标竞争,鼓励投标人通过技术、工艺更新、优化设计及施工组织方案,强化企业内部管理等一系列做法,真正节约工程成本,降低投标报价,以合理的低价去竞标,从而达到提高投资效益及保证招投标双方合法的经济利益的目的。

According to the international tradition and the Bid Law of China, some issues on the Evaluated-Lowest-Cost-As-Bid- Winner Approach, including its meaning, significance, some wrong as well as the right understandings are discussed in this paper. The Evaluated-Lowest-Cost-As-Bid-Winner Approach aims to improve the investing efficiency and guarantee the benefits of the bidding inviter and the bidder. The bidders are encouraged to bid at rational low quotes by legitimate competition. Such measures as technology innovation, design and construction optimization, enterprise management improvement, etc. should be adopted to reduce their engineering costs and minimize their bidding quotes.
