关于对行政公益诉讼原告主体资格的思考

A Consideration on Administrative Public Welfare Lawsuit Plaintiff Main Body Qualifications

建立行政公益诉讼程序首先要解决的就是如何确立行政公益诉讼原告的主体资格问题。检察机关在行政公益诉讼中作为原告起诉具有很大的优势,但同时又有一些无法克服的缺陷。解决的路径是建立行政公益诉讼原告主体多元化的诉讼机制,即在检察机关主要作为行政公益诉讼原告的同时,社会组织和公民个人作为其重要的补充,本文对此进行了简要的评述和论证。

To establish public lawsuit procedure, the first problem we should solve is how to establish the qualification for the main body of the public lawsuit plaintiff. As the plaintiff, the inspection authority has great advantages for suring in the administrative public welfare lawsuit. Meanwhile, there are some inevitable defects. This article puts forward the standpoint of multiplication of main body of plaintiff in public lawsuit the inspection authority functions as the plaintiff of the administrative public welfare lawsuit while social organization and citizen as the main supplement.
