法哲学与法理学关系辨析

On the Distinction between Jurisprudence and Legal Philosophy

理论学界存在着法理学与法哲学的争辩。文章从法哲学与法理学的争论入手;对法哲学与法理学的概念进行分析并加以区别;提出法哲学是较法理学更高层次的理论学科,将两者加以明确的区分对理论法学的建设具有重要的学科意义。

There exists argument between jurisprudence and legal philosophy in academic circles. This article begins with the disputation of jurisprudence and legal philosophy, and then discusses the concept of jurisprudence and legal philosophy. It is suggested that legal philosophy is a more advanced theoretical discipline than jurisprudence. Making an explicit distinction between them has important subject significance to the theoretical discipline.
