摘要
建筑物区分所有权是以某一特定部分为客体而成立的不动产所有权,学界通说认为其是一种三元结构的复合所有权,即包括专有权、共有权和成员权三个部分,与之相对应的,形成相邻关系、共有关系与团体关系。从这三部分的权利内容深入分析了物权立法需要继续加以完善的地方。
The condominium ownership refers to property titles, which takes a certain particular part as its object. The academic circle regards it as the composite ownership of three levels, namely, exclusive function, community and membership. Related to this are formed three relationships: adjacent,common and collective. From the contents of the three part rights, the present author makes thorough analyses of the some contents which still need improve in the property law.
