民间传统体育的著作权保护研究

Research on Copyright Pretection of Folk Traditional Sport

阐述民间传统体育的特征及适用著作权保护的国际立法趋势。指出:民间传统体育具有著作权客体的基本属性(独创性与可复制性),但在权利主体、权利范围和权利期限方面与传统著作权制度又存在着明显的冲突。尽管目前联合国等国际组织的一些法律文件以及非洲国家缔结的版权公约将民间传统体育纳入著作权保护中,但对于解决两者冲突未给出明确答案。认为:民间传统体育应当受到著作权法保护,并对传统著作权制度进行一些创新性适应,包括引入集体著作权人制度、限制经济权利、规定民间传统体育永久保护期等。

It expounded the characteristics of the folk traditional sport and the trend.of international legislation applicable to copyright protection and pointed out that the folk traditional sport had the basle attribute of copyright object, oringiality and reproducibility, but it remarkably collided with the traditional copyright systern in the aspects of the sujeet, extent＇and time limit of rights. Although some legal documents of international organizations, such as United Unions etc. and the copyright conventions concluded by African countries brought the folk traditional sport into copyright protetion, neither of them gave a clear answer to solve the above collision. It holds that the folk traditional sport should be gained copyright protection, make some innovative adaptation to the traditional copyright system, which includes introducing collective copyright system, restricting economic right, prescribing permanent protection term of the folk traditional sport and so forth.
