摘要
采用文献资料、法理论证和案例分析等研究方法,阐述知名运动员形象商品化权的内涵及特点,对保护知名运动员形象的商品化权的法律依据、正当性和必要性进行了探讨。认为:根据现有法律规定和现行的“举国体制”,该项权利仍属一种应然而非实然的法益,因而需要进行有利于各方利益保护与平衡的制度安排。论述立法模式的选择以及商品化权的法定与约定限制。
The methods of literature, jurisprudential demonstration, case analysis etc, were used to set forth the connotations and characteristics of commoditized fight of famous athletes' image and make an appoaeh of the legal basis, legitimacy and necessity to protect the commoditized fight of famous athletes' image. It believes that according to the existing legal regulation and "national system", the above right still belongs to a kind of fight legal benefits but not real one, so it is necessary to make a constitutional arrangement that help to protect and balance the benefits of the parties concerned. It put forward the selection of legislative model and the lawful and appointed limitations.
