摘要
《中华人民共和国道路交通安全法》第76条规定了我国道路交通事故减轻承担责任的条件:有证据证明非机动车驾驶人、行人违反道路交通安全法律、法规;有证据证明机动车驾驶人已经采取必要处置措施。文章通过对案例的分析就这两个条件进行了论述。
Article 76 in Traffic Safety Code of People＇s Republic of China stipulates the conditions of mitigated responsibility in road traffic accidents：the proofs that non - mobile drivers or ped estrians have breached the code and the proofs that the mobile drivers have already taken the necessisary measures This article discusses the two conditions through the analysis of cases.
