我国社区矫正制度的实践与思考

The Practice and Thoughts on Our Country's Community Correction

社区矫正制度作为一种人道、有效和经济的服刑人员处遇制度,已被世界多数国家接受和认可。为了探索符合我国国情的社区矫正之路,我国已开始在部分城市进行社区矫正的试点工作。其中北京、上海、天津等城市的试点工作已初见成效,为社区矫正的立法提供了借鉴依据:社区矫正应以“矫正”为宗旨;突出行刑经济化原则;以成熟的社区为保障;理性运用这一制度,杜绝滥用。

As a moral , effective and economic prisoners＇treatment system, community correction system has been accepted by most of the countries of the world. To explore a right community correction method that fits for our country, we carry out community correction work in some cities as experimental units. And Beijing , Shanghai , Tianjin, etc. have already achieved good results, which provides the learning basis for the legislation of community correction： community correction should be based on correction; it should stress the economic principle of carrying out penalty; it should take mature community as guarantee. We should use this system rationally and put an end to abuse it.
