Analysis on the Structure of Property Rights from the Angles of Law and Economics

科斯定理的存在需要特定的条件,当该条件不满足时,就需要采用“法律模拟市场”来配置产权。产权保护要遵循一定的原则,但法和经济学对科斯定理的拓展存在着无法克服的矛盾。

Coase Theorem exists in specified terms. If the terms cannot be met, property rights should be allocated during “Law Mimicking the Market”. Protection of property rights should obey some rules. But there are serious problems in the development of law and economics for Coase Theorem.
