突破上位法时的抵触标准——以“其他规范性文件”为研究基点

The Contradiction Standards when Breaking through Higher Rank Laws——Taking "Other Normative Document" as a Research Basic Point

是否与上位法相抵触是其他规范性文件合法性审查之重要标准。其他规范性文件数量庞大、体系复杂,认定其与上位法之间是否相抵触至今没有明确的标准,尤其是在突破上位法时。除了授权立法之外,其他规范性文件依其性质和内容不同,在一定条件下也可以突破上位法的范围作出规定,但要符合上位法基本原则和立法目的,不超越立法权限,遵循规范化制定程序,不违背强制性规定,不对抗其他合法权利或符合情势变更原则。

Whether they are conflicting with a higher rank law is the important standard of validity of other normative documents . Because other normative documents are huge in quantity and complex in system, it is difficult to recognize whether they conflict or not, and in particular when they break through the scope of higher rank laws, there is not the explicit limits regarding this in existing laws in our country. Except for delegated legislation, other normative documents also can break through the scope of higher rank laws to some degrees according to their character and content. However, they must obey the principles and aims of higher rank laws, do not surpass the limits of legislation capability, conform to the procedure of normative law-making, do not violate compulsory regulations, do not counter other legal rights, or must follow the principle of the change of circumstances.
