Along with the high new technical in development increasingly, the problem of technical standard has become the focal point in the educational world. This article discusses the elementary theory of technical standard firstly, such as the concept, types. Afterwards, it debates the relationship between technical standard and intellectual property , then analyzes the legal question brought out by the combination of them from the intellectual property angle, and proposes some measures in the end.
