摘要
介绍了法定许可使用的概念,分析了《关于审理涉及计算机网络著作权纠纷案件适用法律若干问题的解释》规定的法定许可使用在数字图书馆的适用与限制,探讨了我国著作权法规定的法定许可使用的不足及其规范。
This paper introduces the concept of legal permitted use, and analyzes the suitability and limitation of the legal permitted use in the digital library specified in 〈the Explanation of Several Problems of the Applicable Laws in the Judgment of the Cases Related to the Dispute of the Computer Network Copyright〉, and probes into the shortages of the legal admitted use specified in our country＇s copyright law and its normalization.
