阐述了商标权和商号权权利冲突的表现形式,分析了这些冲突产生的原因,确立了商号权应有的法律地位,明确了商标权和商号权作为“在先权”的具体范围,并在建立统一商号检索系统的基础上,建立了商标与商号交叉检索系统,从而避免商标权与商号权发生冲突。

This paper expounds the expression forms of the rights conflicts between the trademark ownership and the corporate name, analyzes on the causes of the generation of these conflicts, establishes the due legal position of the trademark, defines the concrete scope of the trademark ownership and corporate name being as the ＂priorities＂, and based on constructing the unified corporate names retrieval system, sets up the trademark and corporate name cross retrieval system for avoiding the generation of the trademark ownership and corporate name.
