Cost Control of Administrative Legal Suit

从法律经济学的角度看,行政诉讼成本是指行政诉讼法律关系主体在实施诉讼行为的过程中所消耗的物质成本、精神压力和错误成本的总和,其构成可分为司法机关的诉讼成本和行政诉讼参与人的诉讼成本。针对影响行政诉讼成本的因素,我国应当在实行诉讼经济原则的前提下,从以下几个方面探索行政诉讼成本的控制路径:确立原告胜诉直接成本为零的转嫁机制;强化行政案件时限的约束;实现司法独立;提升法官素质;设立行政诉讼简易程序;实行行政附带民事诉讼;建立行政诉讼和解制度等。

According to Legal economics, the cost of administrative litigation refers to a total amount of material consumption, nervous and tensions and wrong cost consumed by the principal part in the suit. And the cost can be divided into different types from different angles. In view of factors influencing the cost, our country should carry out economical principle firstly, and try to find out such ways of controlling the cost as the followings： establishing the mechanism of transferring plaintiff＇s direct cost to zero if he wins, strengthening time restraint in administrative cases, realizing jurisdiction independence, promoting judges＇ qualities as a whole, setting up simple procedure, implementing administrative litigation with incidental civil action, founding reconcilable institutions in administrative litigation and so on.
