我国专利技术公开标准的解读与评析——兼谈技术保护的方式

Interpretation and Analysis on the Standards of the Open of Patented Technology in China——also on the modes of technology protection

我国专利法要求申请专利的技术方案必须充分公开,但不同时期的专利法实施细则对此的解释却不尽相同,总体上是由要求完全、彻底的充分公开到比较灵活且更切合实际的“有限公开”的发展。现行的专利法律制度要求的有限公开的技术公开标准给专利保护和技术秘密保护相结合的技术保护方式提供了充分的法律依据。技术保护方式的选择应当以技术拥有人的利益最大化为原则,视具体情况而定。

It is required in China＇s Patent Laws that the technology scheme in the patent application shouM be fully open, which, however, the detailed rules of patent laws in different times interpret differently. The interpretations vary from thorough open to more flexible and practical ＂limited＂ open. The limited technology open standards required by present laws and systems provide sufficient legal bases for technology protecting modes for both patented technology protection and technical secret protection. The choice of technology protecting modes should be based on the principle of interest maximization depending on different situations.
