浅谈土地执法监察难现象、原因及对策

Discuss on the Phenomenon, the Reason and the Countermeasure in the Land Law which is Difficult to Executive and Monitor

本文试图阐述在社会主义市场经济初期资本积累阶段,一些单位或个人为了眼前利益出现的土地违法案件中土地执法监察难表现的五种现象:即发现难、定性难、制止难、处理难、执行难;着重分析了造成土地执法监察难的社会因素、法律因素、体制因素和社会条件因素等四个主要因素,提出了在新形势下如何进行法制、机制、体制创新,解决土地执法监察难的三大对策。

In this article, the author put up the five phenomena which is appeared in the land illegal case, it＇s to discover difficultly, to qualitative difficultly, to stop difficultly, to process difficultly and to carry out difficultly. Then to analyze emphatically the social factor, the legal factor, the system factor and the social condition factor and so on, at last, the author proposed how to innovate the legal system, the mechanism, the system in order to solute the difficulty of land law executive and monitor.
