Philosophic Background of Rise of Modern Jurisprudent Methodology

现代法学方法论所要解决的核心问题是法律规范与案件事实之间的缝隙或矛盾。这个问题在哲学中就是一般与个别的关系问题。西方哲学从古希腊时代起就在努力解决这个问题。在现代西方哲学中,真正对该问题有所突破的是胡塞尔所创立的现象学。因此,现象学就为现代法学方法论提供了坚实的认识论基础。

The central issue that the contemporary methodology of jurisprudence try to resolve is the gap or contradiction between legal norms and case. The issue is expressed in the philosophical terms, the relation between the individual and the general. From the time of the ancient Greece, the west philosophers have been studying it. Edmund Husserl who created phenomenology attained a breakthrough on the research. Thus, a sound epistemological base of the contemporary methodology of jurisprudence is founded by the Phenomenology.
