从1929年《华沙公约》到1999年《蒙特利尔公约》,华沙公约体系一直致力于统一国际航空运输承运人规则,以成功的国际实体法著称于世。然而,各国间在国际航空运输概念的界定以及公约体系适用范围这些基本问题的解释上仍然存在分歧,这直接影响到公约的适用以及统一规则的贯彻执行,也给一些绕过公约而适用本国国内法的作法提供了便利。因此准确界定国际航空运输的概念以及1999年《蒙特利尔公约》的适用尤显重要。
From Warsaw Convention 1929 to Montreal Convention 1999, the Warsaw Convention System consistently devotes itself to unifying the rules governing international air carriers, making itself a successful paradigm of international uniform substantial law. However, the disputes on the defmition of International Air Transport and scope of the convention's application still exist, which directly influence the application of the Convention and facilitate the loopholestaking activities of convention evasion. So, it's important to define the notion of International Air Transport and the application of Montreal Convention 1999 precisely.
