摘要
食品的最基本功能在于维持生存,安全则是食品的基本属性。食品安全监管既在微观层面保障基本人权,又在宏观层面保证社会和谐与可持续发展。食品安全监管不力,既有法律资源供给不足、社会经济二元结构等宏观原因,也有个体安全意识差等微观原因,但关键还在于监管组织体系混乱的问题。《农产品质量安全法》的颁布,为食品安全问题的解决提供了启示,根据这一启示,文章提出了完善监管体制,合理配置监管权力的思路。
The most basic function of food lies in maintaining survival, while safety is the basic property of food. Supervising and managing the food safety safeguard basic human rights in microscopic level and guarantee social harmonious sustainable development in macroscopic level. The reasons for the deficiency of food safety supervising and managing lie not only in the macro levels as legal resources supplies insufficiency, the supervising and managing organization body chaotic, the socio-economie structures, but also in the micro aspect like the individual safe consciousness inferior. However, the key problem is concerned about the supervising and managing organization. The en-aetion of Agricultural product Quality Security Law has provided for food security problem a solution, that is to use this opportunity to consummate the supervising and managing system while reasonably dispose the supervising and managing authority.
