摘要
在刑罚社区矫正模式产生与发展的过程中,始终交织着强调公正还是强调效益、刑罚应当严苛还是应当轻缓、应当公权优先还是应当人权优先等价值冲突和选择。在刑罚公正与刑罚效益的矛盾选择中,非监禁性质的社区矫正模式注重的是实现刑罚效益;在刑罚严苛还是轻缓的矛盾选择中,社区矫正模式是对刑罚轻缓的坚决选择;在公权优先还是人权优先之间的矛盾选择中,社区矫正模式则明显地强调对人权的保护。
There have existed some values conflicts and choices, such as stressing justice or efficiency, strict or easy about punishment, public power first or private right in emerge and develop process of community corrective pattern of punishment. How to make a choice between punishment justice and efficiency, between strict punishment and easy, between power first or right, maybe community corrective pattern is a good choice, as an efficiency choice, as an easy choice first, as a right choice first.
