分时度假合同初探

A Simple Probe into the Time-sharing Contract

分时度假合同是契合人类多元消费需求而产生的一种新型合同。世界上的一些发达国家或地区对该合同有相对完善的法律规制制度。但在我国尚付之阙如。因此笔者建议:应将分时度假合同成文法化;立法时应参照一些国际组织的规范立法和行业规定,同时要结合我国当前休假制度、冷静期制度、格式合同的异常条款绝对无效制度以及开发商的信息披露和保证制度等等有效应对格式合同之弊端的制度都应当准确和全面地予以规定。

Time-sharing contract is a new type of contract whose appearance is just suitable for meeting the diversified needs of human being. As to the contract, compared with some developed countries or regions in the world, our country has not yet the relatively perfect regulatory rules. Through the comprehensive probe into the meaning, characteristics and legal effects of the contract in the view of the comparative law, its general profile in theory will be understood and the corresponding legislative suggestions based on the comparison will be advanced in the last part of the article.
