制定《循环经济促进法》的立法构想

A Legislative Thought Cast in the Frame of the Act of Development of Circular Economy

发展循环经济是建设和谐社会、实践可持续发展战略的基本经济发展模式。发展循环经济需要国家的法律支持,但现行的法律无法满足从全局的高度统领发展循环经济的要求。因此,我们应该借鉴发达国家关于循环经济的立法模式,根据我国的国情尽快制定《循环经济促进法》,并将其定位为循环经济法律体系中的基本法。《循环经济促进法》中应创设发展循环经济的规划制度、绿色GDP制度、循环经济的科技支撑和示范制度、抑制废物形成制度、产品回收利用制度等十大法律制度。制定《循环经济促进法》的过程中,还要理清和调整循环经济促进法与环境法、经济法等相关法律的关系。

Developing circular economy is a basic paradigm of economic development, which can ensure that a sustainable development policy will be followed and a harmonious society be built. Unfortunately, the existing law, a key factor to guarantee the smooth development of circular economy, fails to meet the general demand of the development. Accordingly, it is urgent for us to pass the Aet of Development of Circular Economy by referring to the experience of the advanced countries and in light of our country＇ s specific situation. The Act will be deemed as the basic law in the legal system of circular economy and ten rules concerning planning, green GDP, technological support and paradigm, etc. , should be laid down in the Act. While passing the Act, we should also clarify the relationship between the Act and other relevant laws, such as environmental law and economics.
