摘要
传统教养矫治理念下的劳教管理、教育模式,与宪法中的人权保障原则面临着直接冲突与挑战。变革教养矫治理念,实行劳教办特色,打破传统的教育内容设计,将个案矫治和心理矫治落到实处,才能与尊重和保障人权的宪法精神相契合。
There is a conflict between traditional working and educating management and the principle of human right guarantee in the constitution. It is necessary to reform traditional education and treatment concept and traditional education content, and to put individual case treatment and psychological treatment into effect. Only in this way the education treatment is in accordance with human right guarantee.
