摘要
本文主要采取了苏力总结的语境论研究进路,运用法社会学方法对我国学位法律制度进行了实证分析,研究的核心是关于学位法律运行中两套制度的关系的分析,这是此前一直未能引起足够重视的一个研究弱项。描述了我国学位法律制度的运行过程并由此揭示了两套制度交叉混同的运行特性。我国学位法律制度是一种学术评判制度与行政管理制度共存一体的二元结构,但在实际运行过程中,两套制度出现了交叉并导致了功能的变异和法定功能的弱化。从经验的角度指出了制度混同的现状和问题,在实证分析的基础上提出了几点关于学位法制建设的参考意见。
The paper adopts the process of contextual theory presented by Suli and analyses the legal system of academic degrees in our country through sociological and empirical methods. The main point is the analysis on the relationship between two legal systems of academic degrees in the process of enforcement, which is a weak point ignored before. The paper describes the process of enforcement of the legal system of academic degrees in our country, and reveals the features of enforcement which two systems alternate. The legal system of academic degrees in our country is a dual structure which the system of academic judgment and the system of administration coexist; however, two systems alternated lead to functional variation and weaken lawful function. Finally, the paper raises some suggestion to improve the legal system of academic degrees.
