默示意思表示可分为积极的默示(以“可推断的”行为而为意思表示)和消极的默示(沉默)。沉默只有在特定情形下,才具有意思表示的效力。沉默属于默示意思表示的一种形式。

The silent declaration of intention can be divided into positive declaration--to be declaration of intention with concluded action-- and negative declaration--silence. Only under the particular conditions, can the silence have the effect of declaration of intention. The silence ought to be a method of silent declaration of intention.
