我国民法典设立第三类民事主体之我见

On the Third Type of Civil Subjects Established in the Civil Law

阐释了未来民法典增设第三类民事主体的必要性;分析了民事主体的资格标准,认为只要具备独立的名称、独立的意志、具有特定的功能就可成为民事主体;比较分析了分别由梁慧星、王利明主持起草的两个民法典草案,认为在民法典中第三类民事主体应该表述为“非法人团体”,并且在立法模式上应该独立设计成章,采用抽象概括加类型化的方法设计法律条文。

The paper explains the necessity of increasing the third type of civil subject in the civil law in the future, and analyses the quality standard of civil subjects, consider that once owning the independent designations, independent will, containing special functions, it would be possible to become the civil subjects, compares and analyses two drafts of civil law which respectively drawed up by Liang Hui-xing and Wang Li-ming. The author considers that the third type of civil subject in the civil law should be described as ＂noncorporate group＂, and should be designed into an independent chaper in the legislation model and adapted the method of abstract summarizing and styling to design the legal provision.
