摘要
公立高校学生违纪处分规则属行政法规范。由此法律性质所决定,高校学生违纪处分规则被要求谨守自身作为法规范的调整范围并同时遵守行政法的基本原则和我国的法律位阶规则。合法的学生违纪处分规则必须具备实体规则合法、程序规则合法和符合行政比例原则等要素。
The public universities＇ punishment rules to disobedient students belong to the administrative laws. Decided by this legal nature, the punishment rule was been demanded to hold the administrative jurisdiction. At the same time the punishment rule must abide the basic principles of administrative laws and the rule of different grade of laws. The lawful punishment rule to disobedient students should fulfil the following demands： entity rule in legal, procedure rule is legal, conform to the principle of administrative proportionality.
