运动员肖像权保护的法律分析——从个案引申出来的法律问题谈起

肖像权是我国法律规定的每个自然人所享有的一项权利,受法律的保护,不容侵犯。有些较知名运动员无疑是社会公众人物,其形象为社会大众所熟悉,其行为也会带来一定的社会效果,所以从这个意义上来说,运动员的肖像权的保护就有了一定的特殊性。文章通过对国内一起著名的运动员肖像权诉讼案件的分析,指出了在我国运动员的肖像权应属于个人,集体肖像权也应在今后的立法中作出相应规定,并提出了在我国运动员维护其肖像权的途径。
