关于农民法律素质问题的实证研究——安阳市农民集体上访事件透析

Study on Instance Concerning Farmer Law Quality——Reflection on Anyang Farmers Appealing to Higher Authority for Help

近些年来日益发展的农民集体上访形势,既反映了农民群众参与政治和社会管理的要求和意愿,也暴露了农民在法律素质方面的深层次问题。对安阳市近年来农民群众集体上访事件的调研表明:农民法律素质有所提高,但仍具有一定的不适宜性和落后性。因而,对农民进行法制教育,成为一项亟应加强、刻不容缓的工作。主要内容是对农民进行宪法教育和有关村民自治的法律制度的教育等。切实可行的途径主要有:推进村民自治,加强政策和法制宣传,派出工作组深入农村农户进行宣讲和解决实际问题,结合典型案例现场讲法,建立面向农民的法律咨询服务和法律援助代理机构等。

In recent years, there are more and more farmers appealing to higher authority for help. It not only reflects farmers＇ strong desires and demands to participate in political and social governing, but also exposes problems concerning farmers＇ law quality. Investigation into these instances shows that farmers＇ law quality should be improved further, though they have some understanding about the law. The emphasis should be put on educating farmers in legal self-governing system, etc. The effective methods adopted are enhancing self-governing, strengthening the propaganda of policy and the law, sending legal exports to the village to help solve their actual problems, to illnstrate typical cases, and to establish the law consulting institution and legal aiding organization.
